A jury convicted Appellant Clayton Jerrod Ellington of murdering his wife Berna Ellington and their twin two-year-old sons, Cameron and Christian. The jury found two statutory aggravating circumstances related to each of the three murders and recommended three death sentences, which the trial court imposed.

The attack came just before 31-year-old Clayton Ellington was sentenced to death for the murders of his wife and twin two-year-old sons. He beat them to death with a hammer in 2006.

Ellington received three death sentences, one for each murder. Ellington called the police to the home claiming that he had found all three bodies. Later, he changed his story claiming his wife had killed the two boys and then he killed her.
