Zapeta, 33, came to the U.S. from Guatemala in 2018, and was deported, but subsequently reentered the country and made his way to New York City.

Zapeta was taken into custody hours after the incident on Dec. 22, after teenagers in Midtown Manhattan identified him on the subway and reported him to authorities.
